Fulfillment Policy

This Fulfillment Policy ("Policy") describes how The Factory Gaming LLC ("we," "us," or "The Factory") delivers digital products and services purchased through thefactorydayz.com (the "Site"). By making a purchase, you agree to this Policy.

1. Nature of Our Products

The Factory sells digital products and services for use on our DayZ game servers. All products are digital, intangible, and exist solely within our DayZ servers, Discord community, or related online services. We do not ship physical goods.

2. Product Categories and Delivery Models

Our products fall into two categories, each with different fulfillment processes:

2.1 Standard Digital Products

Standard digital products are pre-built items, services, or access privileges delivered automatically without customer consultation. These may include (but are not limited to) priority queue subscriptions, cosmetic skin packs, Discord supporter roles, and similar pre-defined products. Standard digital products do not require the customer to provide any creative input beyond identifying their in-game character.

2.2 Custom Commissioned Products

Custom commissioned products are unique digital assets created by The Factory based on materials and specifications the customer provides. These currently include custom base flags and custom base wallpapers, and may expand in the future. Custom commissioned products require the customer to open a support ticket in our official Discord at discord.gg/TheFactoryDayZ to provide design specifications, source images or logos, in-game character information, and any other details needed to complete the commission.

3. Order Processing and Delivery

3.1 Standard Digital Product Delivery

Standard digital products are delivered automatically through our backend systems shortly after payment is confirmed. Most standard products are available in-game, in Discord, or on the relevant server within a few minutes of purchase, though delivery may take up to twenty-four (24) hours depending on system status, server restarts, and verification processes.

If a standard digital product has not been delivered within twenty-four (24) hours, please open a support ticket in our Discord and we will investigate.

3.2 Custom Commissioned Product Delivery

After completing a purchase of a custom commissioned product, the customer must open a support ticket in our Discord at discord.gg/TheFactoryDayZ to begin the fulfillment process. We will discuss design requirements within the ticket, share preview images where applicable, and confirm final details before delivering the asset in-game.

We make commercially reasonable efforts to deliver custom commissioned assets within five (5) business days of receiving complete order information through the Discord ticket. Most custom orders are completed within twenty-four (24) hours of receiving design information, though some orders may take longer due to factors outside our control, including scheduled server mod updates, server downtime, Bohemia Interactive game updates, customer revision requests, and the complexity of the requested asset. We will communicate any delays through the ticket associated with your order.

Failure to open a Discord ticket or provide the information needed to complete a custom commissioned order may result in indefinite delay of delivery, for which we are not responsible.

4. Design Approval and Revisions (Custom Commissioned Products Only)

For custom commissioned products, design revisions, adjustments, and feedback are handled directly within the Discord ticket prior to in-game delivery. We aim to deliver an asset the customer is happy with and will work in good faith to address reasonable revision requests during the ticket consultation. This section does not apply to standard digital products, which are pre-built and not subject to customer revision.

Once an asset has been delivered in-game and the ticket has been closed, the order is considered complete and final.

5. All Sales Final — No Refunds

This no-refund policy applies regardless of:

• Whether the customer is satisfied with the final asset, provided we acted in good faith during the consultation process
• Whether the customer is subsequently banned, kicked, or otherwise restricted from our servers for violating community rules or Bohemia Interactive's terms
• Whether the customer loses access to the in-game item through gameplay, character death, base destruction, or any other in-game event
• Whether the customer no longer wishes to play on our servers
• Server downtime, server retirement, or discontinuation of any specific server

Notwithstanding the foregoing, The Factory Gaming LLC reserves the right, at its sole discretion, to issue refunds or credits in exceptional circumstances. Any such refund is granted as a courtesy and does not waive this no-refund policy for future transactions.

6. Chargebacks

Initiating a chargeback or payment dispute through your credit card issuer, bank, or payment provider after an order has been fulfilled constitutes a breach of these terms. Customers who initiate chargebacks may be permanently banned from all The Factory servers, Discord communities, and future purchases. We reserve the right to dispute chargebacks with documentation of the completed fulfillment.

7. Content Restrictions (Custom Commissioned Products Only)

The following content restrictions apply to materials customers submit for custom commissioned products. These restrictions do not apply to standard digital products, which do not involve customer submissions.

We reserve the right to refuse, cancel, or remove any custom commissioned order at our sole discretion, including but not limited to orders involving the following prohibited content:

7.1 Copyrighted and Trademarked Material

You may NOT submit, request, or include any copyrighted, trademarked, or otherwise protected intellectual property that you do not personally own or have explicit written permission to use. This includes, without limitation:

• Corporate logos, brand marks, or trademarks (Nike, Coca-Cola, sports team logos, etc.)
• Imagery from films, television shows, video games, anime, comics, or other media
• Characters, mascots, or artwork created by other artists or studios
• Album covers, band logos, or music-related artwork
• Memes or images created by identifiable third parties without their permission
• Imagery generated from another artist's work, including AI-generated content trained on or imitating identifiable copyrighted styles or characters

If you submit copyrighted or trademarked material that you do not own or have rights to use, we will refuse to fulfill your order. Repeated submissions of infringing content may result in a permanent ban from our services without refund. You agree that you, and not The Factory Gaming LLC, are solely responsible for any copyright or trademark infringement arising from content you submit.

7.2 Other Prohibited Content

We will also refuse orders involving:

• Sexually explicit, pornographic, or NSFW content
• Hate symbols, slurs, or content promoting violence, discrimination, or extremism
• Imagery of real, identifiable persons without their explicit consent
• Politically inflammatory content that may incite community conflict
• Content that violates Bohemia Interactive's terms of service or community standards
• Any other content we determine, in our sole discretion, to be inappropriate for our community

7.3 Refunds for Refused Orders

If we refuse an order under this section before any work has been performed, we will issue a full refund to the original payment method. If the customer refuses to provide acceptable alternative content after we have refused infringing or prohibited content, we will issue a refund and close the order. No refund is owed if we discover after delivery that submitted content was infringing or otherwise prohibited; in such cases, we will remove the asset from our servers and may terminate the customer's access without refund.

7.4 Customer Warranty and Indemnification

By submitting any content for use in a custom asset, you warrant and represent that: (a) you own all rights to the content, or have express written permission from the rights holder to use it for the purpose of creating an in-game asset; (b) the content does not infringe any copyright, trademark, publicity right, privacy right, or other right of any third party; and (c) the content complies with all applicable laws. You agree to defend, indemnify, and hold The Factory Gaming LLC harmless from any claim, demand, lawsuit, or expense (including reasonable attorneys' fees) arising from a third party's claim that your submitted content infringes their rights.

8. Asset Removal and Server Changes

Purchased custom assets exist solely within our DayZ servers and are subject to game updates, server wipes, mod changes, and operational requirements. By purchasing, you acknowledge and agree that:

• Custom assets may be temporarily unavailable during server maintenance, wipes, or mod updates
• Custom assets may be permanently removed if they are later determined to violate Bohemia Interactive's monetization policy or other applicable terms
• Custom assets are non-transferable and are tied to the purchasing player's account
• Continued access to custom assets requires the relevant server to remain operational

9. Bohemia Interactive Monetization Compliance

The Factory Gaming LLC is an approved monetized DayZ server provider listed on Bohemia Interactive's official monetized servers directory. All products sold through our Site comply with Bohemia Interactive's Monetization of DayZ Servers rules. Our products are limited to cosmetic and access-related items that do not affect gameplay balance, and we do not sell in-game currency, weapons, ammunition, vehicles, gameplay advantages, or other prohibited items.

Privacy Policy

The Factory Gaming LLC ("we," "us," or "The Factory") respects your privacy. This Privacy Policy describes the information we collect through thefactorydayz.com (the "Site") and our associated services, how we use it, and your rights regarding that information.

1. Information We Collect

1.1 Information You Provide Directly

When you make a purchase or interact with our services, we collect:

• Your email address (for receipts, order communication, and account identification)
• Your Steam account information via Steam OpenID authentication, including your SteamID64 and public Steam profile name
• Your Discord username, user ID, and server membership information when you link your Discord account or open a support ticket
• Order details and design information you share with us during the fulfillment process

1.2 Information Collected Automatically

When you visit the Site, we automatically collect limited technical information, including:

• IP address
• Browser type and version
• Pages viewed, time spent on the Site, and referring URL
• Device type and operating system

1.3 Information from Payment Processors

Payments are processed by Stripe, Inc. ("Stripe"). We do NOT collect, store, or have access to your full payment card details, bank account numbers, or other sensitive financial information. Stripe provides us only with limited transaction metadata such as the transaction ID, amount, currency, last four digits of the payment method, and your email address. Stripe's handling of your information is governed by Stripe's privacy policy, available at stripe.com/privacy.

2. How We Use Your Information

We use the information we collect to:

• Process and fulfill your orders
• Verify your in-game identity for delivery of custom assets
• Communicate with you about orders, support tickets, and service updates
• Apply purchased benefits (such as Discord roles or server access) to your accounts
• Detect and prevent fraud, abuse, and violations of our terms
• Comply with legal obligations, including tax and accounting requirements
• Improve our Site, products, and customer experience

3. How We Share Your Information

We do not sell, rent, or trade your personal information. We share information only as necessary to operate our business:

• With Stripe to process payments
• With Google (Firebase) for storage and infrastructure
• With Discord for community and ticket management
• With Bohemia Interactive only to the extent required by their monetization compliance program
• With tax authorities, law enforcement, or other government agencies when required by law
• With successors in interest in the event of a merger, acquisition, or sale of The Factory

4. Data Retention

We retain personal information for as long as necessary to provide our services, comply with legal obligations (including tax record retention requirements under federal and Pennsylvania state law), resolve disputes, and enforce our agreements. Inactive account information may be deleted after a reasonable period.

5. Your Rights

Depending on your jurisdiction, you may have the right to:

• Request access to the personal information we hold about you
• Request correction of inaccurate personal information
• Request deletion of your personal information, subject to our retention obligations
• Object to or restrict certain processing of your personal information
• Withdraw consent for processing that relies on consent

To exercise any of these rights, contact us via our Discord ticketing system at discord.gg/TheFactoryDayZ. We will respond within a reasonable time. Note that deleting your information may prevent us from delivering products or services you have purchased.

6. Cookies and Similar Technologies

The Site uses cookies and similar technologies for essential functions such as authentication (Steam sign-in sessions), shopping cart management, and basic analytics. By using the Site, you consent to our use of cookies. You can disable cookies in your browser settings, but doing so may limit Site functionality.

7. Children's Privacy

The Site is not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete it. Parents who believe their child has provided us information should contact us via our Discord ticketing system.

8. International Users

The Factory Gaming LLC is based in the United States and our servers and service providers are located in the United States and other jurisdictions. By using the Site, you consent to the transfer, storage, and processing of your information in the United States and other countries, which may have data protection laws different from those of your country of residence.

9. Security

We take commercially reasonable measures to protect your information, including encrypted connections (HTTPS), secure third-party processors (Stripe, Firebase), and access controls. However, no system is completely secure, and we cannot guarantee absolute security of your information.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this Policy will reflect any changes. Continued use of the Site after changes constitutes acceptance of the updated Policy.

Terms of Service

These Terms of Service ("Terms") govern your access to and use of thefactorydayz.com and related services (collectively, the "Site"), operated by The Factory Gaming LLC ("we," "us," "The Factory"). By accessing the Site, creating an account, or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old to make a purchase on the Site, or 13 years or older to create an account and use non-purchase features with the consent of a parent or legal guardian. By using the Site, you represent that you meet these age requirements.

2. Account and Authentication

Certain features of the Site require you to authenticate through Steam using Steam OpenID. You are responsible for maintaining the security of your Steam account, your Discord account, and any other credentials used to access our services. You are responsible for all activity that occurs under your accounts.

You agree to provide accurate information, including the correct in-game character name, SteamID64, and Discord identifier when ordering custom assets. We are not responsible for delivery errors caused by inaccurate information you provide.

3. Acceptable Use

You agree NOT to:

• Use the Site for any unlawful purpose or in violation of any applicable federal, state, local, or international law
• Impersonate The Factory staff, other users, or any other person
• Attempt to gain unauthorized access to our systems, accounts, or data
• Use automated means (bots, scrapers, scripts) to access or interact with the Site without our prior written consent
• Engage in any conduct that interferes with the operation of the Site or the use of the Site by others
• Submit content for custom assets that violates the content restrictions described in our Fulfillment Policy
• Engage in fraudulent payment activity, including unauthorized chargebacks

4. Intellectual Property

The Site, including its design, layout, text, graphics, logos, and the The Factory brand, is owned by The Factory Gaming LLC and protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any portion of the Site without our prior written permission, except for temporary copies incidental to normal browsing.

4.1 Customer Submissions

When you submit images, logos, designs, photos, artwork, text, or any other content (collectively, "Customer Submissions") for the creation of a custom asset, you represent, warrant, and agree to all of the following:

• You own all rights, title, and interest in the Customer Submission, OR you have obtained explicit written permission from every rights holder to use the content for the purpose of creating an in-game asset on a commercial gaming server
• The Customer Submission does NOT contain any copyrighted, trademarked, or otherwise legally protected material owned by third parties (including but not limited to corporate logos, brand marks, characters from films, television, video games, anime, comics, sports team logos, band logos, album covers, memes created by identifiable third parties, or AI-generated imagery that imitates identifiable copyrighted styles or characters)
• The Customer Submission does not infringe any copyright, trademark, publicity right, privacy right, moral right, or other right of any third party
• You have the legal authority to grant the license described below

You grant The Factory Gaming LLC a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and incorporate your Customer Submission into the custom asset and to display that asset within our game servers and related promotional materials.

If we determine, in our sole discretion, that a Customer Submission contains infringing or prohibited content, we will refuse the order and may terminate your access to our services without refund. You agree to defend, indemnify, and hold The Factory Gaming LLC, its owners, officers, and affiliates harmless from any claim, demand, lawsuit, damages, fines, or expenses (including reasonable attorneys' fees) arising out of or related to your Customer Submissions, including without limitation any claim that a Customer Submission infringes a third party's intellectual property or other rights.

This indemnification obligation survives termination of these Terms.

4.2 Third-Party Intellectual Property

"DayZ" is a registered trademark of Bohemia Interactive a.s. The Factory is an approved monetized server provider but is not affiliated with, endorsed by, or sponsored by Bohemia Interactive beyond that approval. All other trademarks, service marks, and trade names referenced on the Site are the property of their respective owners.

4.3 DMCA / Copyright Infringement Notices

The Factory Gaming LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that content displayed on our Site or within our DayZ servers infringes your copyright, please send a written notice to our Discord ticketing system at discord.gg/TheFactoryDayZ that includes:

• Your physical or electronic signature
• Identification of the copyrighted work you claim has been infringed
• Identification of the material you claim is infringing and its location on our Site or servers
• Your contact information (address, telephone number, email)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

Upon receipt of a valid DMCA notice, we will promptly remove the allegedly infringing content and may terminate the account of the user who submitted it. We may also forward the notice to the user responsible for the submission.

5. Purchases

All purchases are governed by our Fulfillment Policy, which is incorporated into these Terms by reference. By making a purchase, you acknowledge and agree to the no-refund policy and other terms set forth in the Fulfillment Policy.

Prices are listed in U.S. dollars. We reserve the right to change prices, modify product offerings, and discontinue products at any time without notice. Applicable taxes will be calculated and collected at checkout where required.

6. Disclaimer of Warranties

We do not warrant the continued availability of any specific DayZ server, mod, or feature. Server availability depends on factors including Bohemia Interactive's continued support of DayZ, third-party hosting providers, and our operational decisions.

You agree to indemnify, defend, and hold harmless The Factory Gaming LLC, its owners, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Site, or any content you submit to us.

9. Termination

We reserve the right to suspend or terminate your access to the Site, our Discord community, our DayZ servers, and any associated services at any time, with or without notice, for any reason including violation of these Terms, our Fulfillment Policy, our community rules, or for fraudulent activity. Termination does not entitle you to a refund of prior purchases.

10. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Cameron County, Pennsylvania, and you consent to the personal jurisdiction and venue of such courts.

11. Dispute Resolution

Before initiating any formal legal action, you agree to first contact us via our Discord ticketing system and attempt to resolve the dispute informally in good faith for a period of at least thirty (30) days.

12. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Site. Changes are effective immediately upon posting. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Fulfillment Policy and Privacy Policy, constitute the entire agreement between you and The Factory Gaming LLC regarding the Site and supersede all prior agreements and understandings, whether written or oral.

Server Monetization Disclaimer

The Factory Gaming LLC operates DayZ community servers under Bohemia Interactive's approved monetization program. The Factory is listed on Bohemia Interactive's official directory of approved monetized DayZ servers.

All paid products and services offered through thefactorydayz.com are limited to cosmetic items, priority queue access, supporter recognition, and other non-gameplay-affecting perks that comply with Bohemia Interactive's Monetization of DayZ Servers rules. We do not sell, and will never sell, in-game currency, weapons, ammunition, vehicles, vehicle spawns, housing, building materials, gameplay advantages, or any other item or service that affects gameplay balance.

"DayZ" and the DayZ logo are trademarks of Bohemia Interactive a.s. The Factory Gaming LLC is an independent server community operator and is not affiliated with, endorsed by, or sponsored by Bohemia Interactive beyond approval to operate a monetized server. Bohemia Interactive's approval of The Factory as a monetized server does not constitute endorsement of any specific product, service, or content offered through this Site.

Customers who believe that any product offered by The Factory violates Bohemia Interactive's monetization rules may report the concern directly to Bohemia Interactive or to The Factory through our Discord ticketing system at discord.gg/TheFactoryDayZ.
